Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website and services provided by Realtor Presence (“Company”, “we”, “our”, or “us”).

By accessing our website, signing a proposal, making a payment or using any of our services, you agree to be legally bound by these Terms. If you do not agree, you must not use our services.

Our services are provided strictly for business purposes. Clients must be at least 18 years of age.

About Realtor Presence

Realtor Presence is a services-based real estate marketing agency, not a software or SaaS company.

We provide professional marketing and digital services to:

• Real Estate Agents

• Realtors

• Brokerages

• Small real estate teams

We work with clients internationally, with a primary focus on the United States, Europe, and the Middle East.

Services Offered

Our services may include, but are not limited to:

• WordPress website design (short-term or long-term contracts)

• Website redesign

• Website maintenance & updates

• SEO services

• Paid search & paid social advertising (Google, Meta, etc.)

• Social media management & marketing

• Email marketing

• Content creation & copywriting

• Branding & visual identity

• Hosting (where applicable)

• AI-assisted tools or integrations (where applicable)

All services, timelines, pricing, and deliverables are defined in a written proposal,

 agreement, invoice, or subscription plan.

Short-Term & Long-Term Website Contracts

Realtor Presence offers both short-term and long-term website contracts, depending on the client’s needs.

Short-Term Contracts

• One-time website projects

• Fixed scope and deliverables

• Defined start and completion timeline

• No ongoing obligation after project completion unless agreed separately

Long-Term Contracts

• Website setup with ongoing services

• Monthly maintenance, updates, SEO, or marketing retainers

• Minimum contract duration may apply

• Services auto-renew unless canceled per Section 10

Contract length, scope, and pricing are clearly outlined before work begins.

No Guarantees Disclaimer

Realtor Presence does not guarantee:

• Search engine rankings

• Leads or inquiries

• Sales or revenue

• Return on investment (ROI)

• Advertising performance or conversion rates

Marketing results depend on many external factors beyond our control, including competition, market conditions, ad budgets, platforms, and client participation.

Any performance discussions are estimates only, not guarantees.

Client Responsibilities

Clients agree to:

• Provide accurate, complete, and lawful content

• Own or have legal rights to all materials supplied

• Ensure compliance with:

  • Real estate advertising regulations

  • MLS / IDX rules

  • Email marketing laws (CAN-SPAM, GDPR, etc.)

  • Advertising platform policies (Google, Meta, etc.)

Realtor Presence is not responsible for legal violations caused by client content or instructions.

Data Privacy Notice: All personal data provided to Realtor Presence will be processed according to our Privacy Policy.

Content Delays & Project Pauses

If a client delays providing content, approvals, or feedback:

• Project timelines automatically shift

• Work may pause without liability

• Additional fees may apply for extended delays

Realtor Presence is not responsible for missed deadlines caused by delayed client input.

Revisions Policy

Unless otherwise stated in writing:

• Projects include up to two (2) revision rounds

• Revisions must relate to the original agreed scope

• Additional revisions or scope changes may incur extra fees

Payments & Billing

Payment Terms

Depending on the service:

• 30%–50% upfront before project start

• Milestone-based payments

• Monthly recurring fees

• Setup fee plus monthly service fee

Work does not begin until the required upfront payment is received.

Late Payments

If payment is late:

• Services pause immediately

• Access to work, accounts, or deliverables may be restricted

• Continued non-payment may result in termination

Subscriptions, Renewals & Cancellation

• Recurring services automatically renew

• Clients must provide 30 days’ written notice to cancel

• No refunds for unused time or partial months

• Early termination does not waive outstanding payment obligations

No Refund Policy

All payments made to Realtor Presence are non-refundable, including:

• Setup fees

• Project fees

• Monthly retainers

• Advertising management fees

Once work has started, no refunds will be issued under any circumstances.

Ownership & Intellectual Property

• Client ownership transfers only after full payment

• Until payment is complete, all work remains the property of Realtor Presence

• Upon full payment, clients receive rights to final approved deliverables only

Realtor Presence retains ownership of:

• Internal processes

• Frameworks

• Templates

• Methods and systems

Portfolio & Marketing Rights

Clients grant Realtor Presence the right to:

• Display completed work

• Use logos, screenshots, and project descriptions

• Reference the client relationship

for portfolio, website and marketing purposes unless restricted in writing.

AI Tools & Automation

We may use AI-assisted tools to improve efficiency or support content creation.

• AI outputs are not guaranteed to be error-free

• Final responsibility for accuracy rests with the client

• No performance guarantees apply to AI-assisted services

Limitation of Liability

To the maximum extent permitted by law, Realtor Presence’s total liability shall not exceed the fees paid for the specific project giving rise to the claim.

We are not liable for:

• Lost profits or revenue

• Business interruption

• Advertising account suspensions or bans

• Platform algorithm or policy changes

• Third-party service failures

Indemnification

Clients agree to indemnify and hold harmless Realtor Presence from any claims, damages, or losses arising from:

• Client-provided content

• Legal or regulatory violations

• Advertising claims

• Third-party disputes

Termination

Realtor Presence may terminate services if:

• Payments are not made

• Terms are violated

• Abusive, unlawful, or unethical behavior occurs

Termination does not remove payment obligations.

Governing Law & Dispute Resolution

These Terms are governed by neutral international principles of law.

Any dispute shall be resolved through international arbitration, conducted in English, before any court proceedings.

Changes to Terms

We may update these Terms at any time.
Continued use of our services constitutes acceptance of the updated Terms.
